Real Estate agents mean a person, who negotiates/facilitates in a sale purchase transaction of plot, apartment or building in a real estate project on fees basis for his services whether as commission or otherwise and includes property dealers, brokers, middlemen etc.

Real estate agent plays a vital role for the robust development of Real Estate Industry. RERA agent works as the bridge for filling the gap in between the allottee and Developers.

The real estate agent shall provide necessary support to able the homebuyer and developers to exercise their respective rights and fulfill their respective obligations at the time of booking and sale of flat.

Applicability

On commencement of RERA Act, 2016, every agent, broker, dealer and mediator or whatsoever name called is required to get registered themselves as Real Estate Agent with RERA.

In present scenario, No agent provide facilitate services in the sale purchase transaction of plot, flat, apartment and building without having a valid registration number issued by REREA Authority.

Working as the real estate agent without having a valid RERA registration number is illegal and punishable in the eyes of law. Such real estate agent shall be liable to a penalty of ten thousand rupees for every day during which such default continues, which may cumulatively extend up to five per cent. Of the cost of unit

Statutory fees for Delhi RERA Agent Registration

  • Fresh Rera Agent Registration
    • - In case of Individual: Rs. 10,000/- (Rupees Ten Thousand Only)
    • - In case of other than individual: Rupees 50,000/- (Fifty Thousand Only)
  • Renewal of Rera Agent Registration
    • - In case of Individual: Rs. 1,000/- (Rupees One Thousand Only)
    • - In case of other than individual: Rupees 5,000/- (Five Thousand Only)

Validity of RERA Registration

This RERA agent registration is valid for 05 (Five) years. Once you are registered as RERA agent with RERA Authority, your registration details shall be published on Delhi RERA Portal.

Renewal: - The RERA registration issued under section 9, may be renewed on an application made by the real estate agent in Form ‘J’ which shall not be less than one month prior to the expiry of the registration granted and such renewal shall be valid for a period five year.

Procedure for RERA Agent Registration

Every agent is required to make an online application to the Authority as per Form ‘G’ for agent registration along with the following documents, namely:-

  • a) In case of an individual:
    • i. Name, address, contact details and email Id of the applicant
    • ii. 2 Photographs of the applicant
    • iii. Self-attested copy of PAN card and Aadhar card of the applicant
    • iv. Self-attested copy of ITR filed for last three financial years of the applicant;
    • v. Proof of place of business documents like Sale Deed, Allotment Letter and copy of receipt of property tax paid at commercial rates to appropriate authority In case of rented/leased property, the rent agreement and NOC from the landlord along with property tax receipt.
  • b) In case of ‘other than individual’:
    • i. Brief details of entity including name, registered address, contact details, Email Ids, photograph(s) of the partners, chairman, directors, etc. As the case may be and that of the authorised persons.
    • ii. Type of enterprise (proprietorship, limited liability partnership, society, partnership firm, company etc).
    • iii. Copy of the Memorandum of Association and Article of Association, partnership deed etc;
    • iv. Certificate of incorporation of the entity;
    • v. Self-attested copy of GST Registration Certificate;
    • vi. Attested copy of PAN card of the company;
    • vii. Self-attested copy of PAN card of all the partners, chairman, directors, etc
    • viii. Self-attested copy of ITR filed for last three financial years
    • ix. Authority letter, for authorised signatory for the proprietorship, limited liability partnership firm, society, partnership, company.
    • x. Proof of place of business documents like Sale Deed, Allotment Letter and copy of receipt of property tax paid at commercial rates to appropriate authority In case of rented/leased property, the rent agreement and NOC from the landlord along with property tax receipt.

After submission of application and payment of RERA registration fees, the authority shall grant a registration certificate with a registration number as per Form ‘H’ to the real estate agent.

Every real estate agent is mandated to make an application to the state Real Estate Regulatory Authority, for registration, along with the fee and documentation that is prescribed.

The real estate agents who fail to apply 15 days prior to the last date of validity of registration or revalidation, shall have to make fresh application in Form ‘G’ for fresh registration with requisite fee.

Every real estate agent shall;

  • Not facilitate the sale or purchase of unregistered projects
  • No involve himself in unfair trade practise
  • Maintain the books of accounts
  • Facilitate the possession of all the information and documents to the buyer

For fresh registration is valid for 5 years and in the case of renewal, it is valid for five years

RERA Authority revokes the registration no if real estate agent commits breach of any of the conditions thereof or any other terms and conditions specified under this Act.
